We take your rights, privacy and security very seriously. The information below might sound a bit formal but it's the legal stuff that's necessary to make sure your experience with the website and Sahara Boston is as secure and easy to use as possible.

 

By placing an order on this website, you are agreeing to the following terms and conditions:

 

Acceptance of terms

 

Sahara Boston's (“Sahara Boston” "we" "us" “our”) website(s) (our "Site" or "Sites") and related services are made available to you in accordance with the following Terms & Conditions of use of service, and any other rules posted on our Sites (collectively, the "T&C"). Please read the T&C carefully before placing any orders with us and on www.saharaboston.com. We strongly recommend you keep a copy of the T&C for future reference.

 

We may update the T&C from time to time (and the documents referred in them). Please read the T&C and check back often. If you do not agree to any change to the T&C then you must immediately stop using www.saharaboston.com. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

 

 

 

OUR PROMISE

 

We aim to bring you original and unique artworks, that are screen printed on to garments that have been ethically and sustainably made using only the highest quality materials. Materials include  either organic cotton, Tencel, LENZING™ECOVERO™, recycled materials, recycled cotton and cotton. All certified by either Global Organic Textile Standard (GOTS), Global Recycled Standard, Organic Blended Content Standard, FairWear, or OEKO-TEX® Confidence in Textiles Standard 100. We aim to make our customers happy with the knowledge that they have contributed to helping the planet by buying eco-friendly and sustainable products, as well as owning unique works of art. We aim to brighten our customers and their friends’ days by delivering beautiful garments, in great condition, every time.

 

PRICES

 

Prices quoted on our website are for the price of the item alone and do not include the cost of postage. The cost of postage and carriage is shown separately. All published prices are subject to change at any time without notice. If you are ordering from outside the UK then you may be charged import duty or tax costs which we have no control over. We recommend you contact your local customs office to determine what additional charges may be applicable. If you are a customer whose credit/debit card is not denominated in Sterling the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

 

PAYMENT

 

We accept Visa, MasterCard and any other methods which may be clearly advertised on the Site from time to time. You can also choose to pay with PayPal. When selecting this option at checkout, you will be directed to the PayPal site to 'Log In' and review the amount shown before clicking 'Pay Now'. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to SAHARA BOSTON, we will not be liable for any delay or non-delivery. Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order.

 

ORDER ACCEPTANCE

 

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it. Unless you cancel your order, acceptance of your order and completion of the contract between you and SAHARA BOSTON will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in London, England and the language of the contract is English.

 

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our high quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the T&C. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. In the event that we make a change or cancel an order, we will notify you by contacting the email and/or billing address/phone number provided at the time the order was made. Additionally, we may limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers, distributors or any other unauthorised party. You are not permitted to resell any products or services purchased through the Site for commercial purposes. If you would like to become an authorised reseller partner please contact hello@saharaboston.com with a message indicating your intentions and contact details.

 

We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun. Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled.

 

COUNTERFEIT PRODUCTS

 

If you are unsure of the legitimacies of a Sahara Boston product, please contact us prior to placing your order. We will determine if you are purchasing from an official, approved Sahara Boston stockist and if the product is genuine. We take infringement of the Sahara Boston brand very seriously and will take legal action against any counterfeiting.

External links may be provided for your convenience, but they are beyond our control and no representation is made as to their content. Use or reliance on any external links and the content therein provided is at your own risk. When visiting external links you must refer to the external website terms and conditions of use.

You further agree not to use the Site or reviews to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane or violates any applicable law and you hereby indemnify us against any loss, liability, damage or expense of whatever nature which we or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post any such message or material.

 

WARRANTIES

 

We make no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the Site, the information contained on the Site, your or your company's personal information or material and information transmitted over our system.

 

DISCLAIMER OF LIABILITY

 

We shall not be responsible for and disclaim all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company's personal information or material and information transmitted over our system. In particular, neither us nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.

 

PRIVACY

 

If you place an order, you will have to provide personal information to us. We will not disclose that information to any third party without your consent, except for the purpose of processing the order and arranging delivery. Please refer to our privacy policy for more details.

 

DELIVERY

 

All our items are handmade, packed and shipped from our studio, please expect standard deliveries to take 1-3 working days within the UK, 5-7 working days for EU, 7-12 working days for the US and 10-15 working days for the Rest of the World. Express delivery typically takes 1-2 business days within the UK and 2-4 working days for the Rest of the World. We will arrange for packing and we will decide on the most suitable method of delivery either by post, courier or otherwise, to get you order to you as promptly as possible. We will give you an estimated delivery date for the Goods. We use Royal Mail, DPD and UPS delivery services, the times or dates provided by them are not guaranteed. You must notify us promptly and in any event within 48 hours or receipt of any Goods if they appear to be damaged in transit. In those circumstances, you must also keep all packaging as this may be required when making a claim.

 

RETURNS

 

Whilst we hope you will be delighted and love your Sahara Boston item as much as we do, if your item is unwanted then you can return it for a refund or exchange. We accept returns on unused items up to 21 days after they are delivered as long as the original packaging, with tags intact, and unworn.

 

Refunds will be credited to the original payment method. 

 

Please note that you're right to cancel or return a product does not apply to personalised products, bespoke corporate orders or subscription orders that are available from our site from time to time. Please note that this does not apply to subscription products, bespoke corporate orders or personalised products that are faulty or supplied incorrectly where the error has occurred on our part where your statutory rights are unaffected. For personalised products it is your responsibility to ensure you provide the correct information to us in terms of personalisation. We will not be held liable for any error made on your part in supplying information for product personalisation.

 

If you wish to return an item please contact returns@saharaboston.com.

 

We recommend returning items to us packaged safely and via a recorded service as we cannot accept responsibility for parcels that are lost or damaged before they reach the studio. Unfortunately, we do not refund any postage or packaging costs.

 

You must take reasonable care of goods that are in your possession. Any item wishing to be returned must be done so unused, in their original condition with all packaging and labels intact and from the country that the order was delivered to. If the items have been used or the labelling has been removed or lost then your return will not be accepted.

 

Please note that if you reside outside of the UK your purchase may be liable to import taxes and duties. If you return your item to us, we are unable to refund any of these charges. Please contact your local customs office for further details as they may be able to help advise further on this.

 

LATE RETURNS

 

Goods returned outside of the above time frame will not be accepted and will be returned to the customer.

 

FAULTY GOODS

 

Faulty goods are classified as faulty if they are received damaged or where a manufacturing fault occurs within six (6) months of purchase. Any items that are damaged as a result of wear and tear is not classed as a manufacturing fault. Please contact our Customer Care team for further details.

 

YOUR RIGHTS

 

You have certain rights under the law. In England these include:

 

That any products you order through this Site will be of satisfactory quality, fit for their intended purpose, and will conform to any description given on this Site;

Certain solutions if a product is defective; and

A right to cancel any order for a product within 14 days after the date of receipt of the product.

Please note you do not have any right to cancel a contract for the supply of products that have been made to your bespoke specifications, personalised or a subscription order, unless such products were damaged, defective or faulty when delivered to you or have been incorrectly delivered.

Nothing in the T&C is intended to affect these rights. For more information about your rights please can you contact your local Citizens Advice Bureau and they should be able to offer you further advice.

 

IMAGES AND COLOURS

 

We take all photography in our studio or in natural light and work hard to display products on our website as accurately as possible but we cannot guarantee your computer, phone or tablet will display colours accurately.

 

RISK AND OWNERSHIP

 

The risk of loss or damage to Goods passes to you upon delivery. Ownership in all Goods remains with us until full payment of all amounts due to us have been received from you. You will be responsible for the safe custody and insurance of all Goods in your possession. You have no right to re-sell any Goods until payment has been received in full by us.

 

INTELLECTUAL PROPERTY RIGHTS

 

Your use of the Site and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the Content displayed on www.saharaboston.com. Where the Goods include designs or works of art, these are either created in our studio by Sahara Boston or licensed from a designer or artist who owns the copyright in those works. You have no right to make any copies or adaptations of any such Goods. Please remember that all copy and images shown on this website are Copyright of SAHARA BOSTON. Images and copy must not be reproduced without our written permission. Action will be taken against any copyright infringement.

 

COMPLAINTS AND GOVERNING LAW

 

If you have a complaint, please contact us by email or in writing giving us full details including date of purchase and order number where applicable and your full name and address and contact details. The T&C together with all our policies and procedures will be governed by and construed in accordance to the English law and the relevant courts of England and Wales will have exclusive jurisdiction.
